NOTICE OF TRUSTEE'S SALE NOTICE IS HEREBY GIVEN that on April 17, 2018, at the hour of ten o'clock a.m. of said day, at the offices of the Trustee, Alliance Title & Escrow Corp., 9465 W. Emerald St., Suite 160, Boise, Ada County, Idaho, said Trustee will sell at public auction to the highest bidder, for cash in lawful money of the United States of America, all payable at the time of sale, the following described real property situated in the County of Ada, State of Idaho, and described as follows, to wit: Lot 22 in Block 3 of Redfeather Estates Subdivision No. 1, according to the Official Plat thereof, filed in Book 89 of Plats at Page(s) 10248 and 10249, Official Records of Ada County, Idaho. The Trustee has no knowledge of a more particular description of the above described real property, but for purposes of compliance with Idaho Code Section 60 113, the Trustee has been informed that the street address of 12383 W. PALM STREET, BOISE, IDAHO, may sometimes be associated with said real property. Said sale will be made, without covenant or warranty regarding title, possession or encumbrances, to satisfy the obligation secured by and pursuant to the power of sale conferred in the Deed of Trust made and entered into on May 21, 2010, by and among BATIRJON MADJIDOV and FERUZAKHON SULTANKHODJAEVA, husband and wife, as Grantor, and TITLEONE CORPORATION, as Trustee, said Trustee having been replaced by ALLIANCE TITLE & ESCROW CORP. as Successor Trustee, and CITY OF BOISE CITY, a municipal corporation of Idaho by and through the Housing & Community Development Division of the Department of Planning and Development Services of said City, as Beneficiary; said Deed of Trust having been filed of record on May 28, 2010, as Instrument No. 110049383, Official Records of Ada County, Idaho. The naming of the above Grantor(s) is done to comply with Idaho Code Section 45-1506(4)(a); no representation is made as to the responsibility of Grantor(s) for this obligation. The default for which the sale is to be made is that the current Beneficiary has declared that the Grantor is in breach of the terms and conditions of the obligation secured by the deed of trust, which terms are set forth in a Promissory Note dated May 21, 2010, and amended September 26, 2015. The nature of the breach is Grantor's failure to reside at and occupy the property secured by the Deed of Trust as Grantor's primary residence, as required by the terms of the Deed of Trust. The balance owing as of the date hereof on the obligation secured by said Deed of Trust is the amount of $14,750.78 in principal; plus accrued interest at the rate of 4.04% per annum from November 20, 2017; plus service charges, late charges, and any other costs or expenses associated with this foreclosure as provided by the Deed of Trust or Deed of Trust Note, or by Idaho law.
