NOTICE OF TRUSTEE'S SALE Trustee's Sale No. ID-PRV-13002631 NOTICE IS HEREBY GIVEN that, Pioneer Title Company of Ada County, dba Pioneer Lender Trustee Services, the duly appointed Successor Trustee, will on November 27, 2013, at the hour of 01:00 PM, of said day, IN THE LOBBY OF PIONEER TITLE COMPANY OF ADA COUNTY, 8151 WEST RIFLEMAN STREET, BOISE, ID, sell at public auction to the highest bidder, for cash, in lawful money of the United States, all payable at the time of sale, the following described real and personal property (hereafter referred to collectively as the "Property"), situated in the County of ADA, State of Idaho, to-wit: Lot 16 of Lot Line Adjustment Survey recorded June 27, 1994 as Instrument No. 94060849, more particularly described as follows: A parcel of land being portions of Lots 15 and 16, Block 1, Triple Ridge Estates, located in the West half of Section 34, Township 5 North, Range 1 East of the Boise Meridian, Ada County, Idaho, being more particularly described as follows: Commencing at the West quarter corner of Section 34, Township 5 North, Range 1 East, Boise Meridian; thence South 85 degrees 17'31" East 354.50 feet to the Westerly corner common to Lots 15 and 16, Block 1; thence North 32 degrees 15'55" West 150.00 feet along the Westerly line of said Lot 15 to the adjusted Westerly corner common to Lots 15 and 16, Block 1, the Real Point of Beginning of this description; thence South 32 degrees 15'55" East 411.07 feet to the platted Southwest corner of Lot 16; thence North 34 degrees 49'26" East 600.73 feet to a point; thence North 12 degrees 45'06" West 85.00 feet to a point of curvature; thence along a curve to the left 166.77 feet, said curve having a radius of 475.00 feet, a central angle of 20 degrees 06'57", tangents of 84.25 feet and a chord of 165.91 feet which bears North 22 degrees 48'35" West to a point on a curve; thence South 68 degrees 50'00" West 325.36 feet to an angle point; thence South 33 degrees 42'00" West 317.22 feet to the Real Point of Beginning of this description. The Trustee has no knowledge of a more particular description of the above-referenced Property but, for purposes of compliance with Section 60-113 of Idaho Code, the Trustee has been informed that the address of LOT 16, TRIPLE RIDGE ESTATES SUBDIVISION , EAGLE, ID 83616, is sometimes associated with said real property. Said sale will be made without covenant or warranty regarding title, possession or encumbrances to satisfy the obligation secured by and pursuant to the power of sale conferred in the Deed of Trust executed by OVERLAND INDUSTRIES, LLC, as Grantor, to PIONEER TITLE COMPANY OF ADA COUNTY, as Trustee, for the benefit and security of MCCALL INVESTMENTS, LLC, as Beneficiary, dated 4/16/2012, recorded 7/12/2013, under Instrument No. 113078384, Mortgage records of ADA County, IDAHO, the beneficial interest in which is presently held by MCCALL INVESTMENTS, LLC. THE ABOVE GRANTORS ARE NAMED TO COMPLY WITH SECTION 45-1506(4)(A), IDAHO CODE. NO REPRESENTATION IS MADE THAT THEY ARE, OR ARE NOT, PRESENTLY RESPONSIBLE FOR THIS OBLIGATION. The default for which is sale is made is the failure to pay when due under the Deed of Trust Note dated 4/16/2012, FAILURE TO PAY THE PRINCIPAL BALANCE WHICH BECAME DUE AT MATURITY, TOGETHER WITH ACCRUED AND ACCRUING INTEREST, CHARGES, FEES AND COSTS AS SET FORTH. All delinquencies are now due, together with unpaid and accruing taxes, assessments, trustee's fees, attorney's fees, costs and advances made to protect the security associated with this foreclosure.
